Terms of Service

MiLEND, Inc. (“MiLEND”, “we”, or “us”) operates a mobile messaging and communications program (the “Program”) subject to these Terms of Service. The Program and our collection and use of your personal information is also subject to our Privacy Policy (https://milend.com/privacy-policy/). By enrolling, signing up, or otherwise agreeing to participate in the Program, you accept and agree to these Terms of Service and our Privacy Policy.
1. Consent to Communications
By providing your phone number and opting into the Program, you hereby provide prior consent to receive recurring automated and non-automated communications from MiLEND, Inc. through:
- Emails
- Autodialed and/or pre-recorded telemarketing calls
- AI-generated calls
- Text messages (including SMS and MMS)
These communications may be sent from or on behalf of MiLEND and our affiliated partners to the telephone number you provided, including your wireless number if applicable.
Important: You understand that providing this consent is not a condition of obtaining credit, purchasing services, or doing business with Milend.
2. Program Description
We may send promotional and transactional mobile messages in various formats through the Program. You may receive the following types of communications:
- Transactional messages: Appointment confirmations, payment reminders, payment receipts, service notifications, and account updates
- Informational messages: Service announcements and important updates about your loan or account
- Marketing messages: Promotional offers, new services, and special deals related to mortgage products you have expressed interest in or that we believe may be relevant to you
Mobile messages may be sent using an automated technology, including an autodialer, automated system, or automatic telephone dialing system. You agree that MiLEND, our affiliates, and any third-party service providers may send you messages regarding the foregoing topics and that such messages and/or calls may be made or placed using different telephone numbers or short codes. We do not charge for mobile messages sent through the Program, but you are responsible for any message and data rates imposed by your mobile provider, as standard data and message rates may apply for SMS and MMS alerts.
3. Message Frequency
The frequency of messages from MiLEND may vary depending on your interaction with our services and the communications you have opted into. You may receive multiple messages per week or month based on your account activity, loan status, or marketing preferences.
Standard message and data rates may apply to any text messages received through the Program.
4. User Opt-In
By providing your mobile phone number to us, you are voluntarily opting in to the Program and agree to receive recurring mobile messages from MiLEND at the mobile phone number associated with your opt-in, even if such number is registered on any state, federal, or company “Do Not Call” list.
By opting in, you confirm that:
- You are the authorized user of the phone number provided
- The phone number you provided is accurate and current
- You are at least 18 years old
- Your participation in the Program is not required to make any purchase from us and is completely voluntary
If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at info@milend.com.
5. User Opt-Out and Support
You may opt out of the Program at any time using any of the following methods:
- Reply STOP or UNSUBSCRIBE to any text message you receive from us

After you opt out you will receive one final confirmation message. You will then no longer receive messages from us unless you opt back in.

Message and data rates may apply. Compatible carriers include: AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, and U.S. Cellular. You agree that MiLEND and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these Terms of Service. We may also change the telephone number or short code we use to operate the Program and will notify you of any such change. You acknowledge that any requests sent to a telephone number or short code that has been changed may not be received by us and we will not be responsible for failing to honor such requests. Operational or legally required communications may continue where permitted by law.
6. Third-Party Communication
You agree that MiLEND and its trusted affiliated partners may contact you for marketing, promotional, or informational purposes related to mortgage products and services you have expressed interest in or that we believe may be relevant to you.
We do not sell your personal information to third parties for their own independent marketing purposes. Any third-party communication conducted on our behalf will be subject to the same opt-out rights described in section 5.
7. Disclaimer of Warranty and Liability
The Program is offered on an “as-is” basis and may not be available in all areas, at all times, or on all mobile providers. Alerts sent via SMS may not be delivered if the mobile phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of the wireless carrier may interfere with message delivery, including the customer’s equipment, terrain, proximity to buildings, foliage, and weather.
The wireless carrier does not guarantee that alerts will be delivered and will not be liable for delayed or undelivered messages. You agree that neither MiLEND nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program.
All messages will clearly identify MiLEND, Inc. as the sender.
8. Modifications<
We reserve the right to modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Terms of Service at any time. When we make changes:
- We will update the “Effective Date” at the top of these terms
- We may notify you of material changes via email, SMS, or our website
- Continued participation in the Program following any changes will constitute your acceptance of those changes
You agree to review these Terms of Service periodically to ensure that you are aware of any modifications.
9. Acknowledgment
By providing your phone number and opting in, you acknowledge that:
- You have read and agree to these Terms of Service
- You understand you can opt out at any time using the methods described in section 5
- You consent to receive automated messages, including autodialed and AI-generated calls and texts, at the number provided
- You understand that consent is not required to purchase our services
- You agree to notify us promptly at info@milend.com if your phone number changes or you are no longer the authorized user of the number provided
10. Privacy Policy
Your information will be used in accordance with our Privacy Policy (https://milend.com/privacy-policy/), which outlines how we collect, use, share, and protect your personal data. We encourage you to review the policy to understand your rights and how we handle your information.
11. Limitation of Liability
To the maximum extent permitted by law, Milend shall not be liable for:
- Delayed messages;
- Undelivered messages;
- Carrier interruptions;
- System outages; or
- Any damages arising from participation in the program.
