  • Information we receive from you on applications, electronic communications, forms and other correspondence, or information that you give us verbally;
  • Information about your transactions with us or others;
  • Information we receive from third parties, including persons providing services to MiLEND concerning your business with MiLEND and consumer reporting agencies;
  • Information obtained by us when verifying any of the above information, including information from employers and other financial institutions with whom you have had financial transactions; and
  • Information collected from you over Internet websites, such as information you provide to us as MiLEND may require for the processing and underwriting of your application.

2.2  Information We Collect Automatically

MiLEND also collects information using technology. We gather (1) clicking, browsing, and use data/patterns (including, but not limited to, information gathered through “cookies” and “pixel tags” as well as information about your IP address, browser, internet service provider, pages, operating system, date/time stamps, and clickstream data), (2) information about your mobile device, use of our app, or app performance and (3) information (via “pixel tags”) about how emails we have sent have been accessed.

3. How We Use Your Information

By submitting your information to MiLEND, Inc. (MiLEND) through our website, affiliates websites, mobile apps, email, SMS, telephone, written communication, or in person, you consent to the use of your nonpublic personal information by MiLEND. We use your information for the following purposes:

3.1  To Process Your Loan Application

We use your personal and financial information to evaluate your eligibility for a loan, process your application, and assist you in making payments.

3.2  To Communicate with You

We use your contact information to send appointment confirmations, reminders, follow-up notifications, and important updates about your loan or our services.

3.3  To Improve Our Services

We use automatically collected data such as browsing patterns and device information to improve and optimize our website and services.

3.4  For Marketing (With Your Consent)

We may use your information to tell you about products, services, and special offers from MiLEND by post, email, phone call, push notification, or text message (SMS).

3.5  For Ongoing Marketing After Loan Servicing Transfer

If your loan is sold or transferred to a third-party servicer, MiLEND may retain your contact information to inform you about additional products and services we offer, subject to your right to opt out at any time as described in section 8.

4. SMS Communications

For all SMS Communications if you decide to discontinue receiving these from MiLEND, Inc., reply with the text STOP. Reply HELP for help, and reply STOP to cancel. Message & Data Rates May Apply. Compatible carriers include: AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular.

Alerts sent via SMS may not be delivered if the mobile phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of the wireless carrier or MiLEND may interfere with message delivery, including the customer’s equipment, terrain, proximity to buildings, foliage, and weather. The wireless carrier does not guarantee that alerts will be delivered and will not be liable for delayed or undelivered messages. 5. How We Share Your Information

MiLEND will not share, rent, or sell your personal information with third parties, other than as disclosed within this privacy policy. We may provide your personal information to companies that provide services to MiLEND to help us to perform marketing services and with our daily business activities such as processing payments, offering customer support, or sending out emails on our behalf. These companies are authorized to use your personal information only as necessary to provide these services to us. We may also disclose your personal information as required by law, such as to comply with a subpoena, or similar legal process, when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

In the event that your loan is sold or transferred to a third-party loan servicer, we may transfer your personal information to that servicer as necessary to service your loan. The servicer will use your information solely for loan servicing purposes.

6. Data Retention

We retain your personal information for as long as necessary to fulfill the following purposes:

  • Provide our services to you
  • Process and service your loan
  • Comply with legal and regulatory obligations, including tax and accounting requirements
  • Resolve disputes and enforce our agreements
  • Meet any applicable statute of limitations requirements

When we no longer need your personal information for these purposes, we will securely delete or anonymize it in accordance with applicable law.

MiLEND takes precautions to protect your information. We limit access to personal information about you to those employees and third parties who need to know that information to provide products and to serve your needs. We maintain physical, electronic, and procedural safeguards to protect your personal information. We regularly assess security standards and procedures to protect against unauthorized access to personal information. All stored personal private information is kept in a secure environment.

8. Your Privacy Rights

You have the right to access, correct, or request deletion of your personal information that we hold. You may also withdraw consent to receive marketing communications at any time without affecting the lawfulness of processing based on consent before withdrawal.

8.1  Opt-Out of Marketing Communications

Your participation in our messaging program is not required to make any purchase from us and is completely voluntary. If you decide you no longer wish to receive marketing communications from MiLEND, you may opt out at any time using any of the following methods:

  • SMS: Reply STOP or UNSUBSCRIBE on SMS communications from MiLEND to opt out. You may continue to receive text messages for a short period while we process your request, and you may receive a one-time opt-out confirmation message. 8.2  Accessing or Correcting Your Information

To request access to, correction of, or deletion of your personal information, contact us at info@milend.com or 855-645-3631. We will respond within a reasonable timeframe and as required by applicable law.

9. Children’s Privacy

Our services are intended solely for individuals 18 years of age or older. We do not knowingly collect personal information from anyone under the age of 18. If we become aware that we have collected personal information from a person under 18, we will take steps to delete that information promptly. We do not discriminate in our products, services, or offerings based on age.

10. Third-Party Links

Our website may contain links to third party websites or applications. These links may send you to third (3rd) party websites or applications which are not part of MiLEND’s website. Neither MiLEND nor its affiliates make any representations or warranties in regard to any third-party websites or applications. MiLEND is not responsible for any losses or damages associated with or caused by the information you provide any third-party websites or applications or by the third party’s website or application’s security, privacy practices, content, or accuracy of materials of these third-party websites or applications. These third-party websites or applications might have Terms of Use or Privacy Policies that differ from MiLEND’s and third-party websites may provide less privacy and/or security than our website. We encourage you to review the Terms of Use and Privacy Policy of all third-party websites or applications before you share any personal information with them.

11. Do Not Track

Some web browsers have a “Do Not Track” feature that sends a signal to websites requesting that your browsing activity not be tracked. Our website does not currently respond to Do Not Track signals. We continue to collect information as described in this Privacy Policy regardless of any Do Not Track signals received.

12. International Data Transfers

MiLEND’s services are intended for residents of the United States. Your personal information is collected, processed, and stored in the United States. If you are accessing our services from outside the United States, please be aware that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country of residence. By using our services, you consent to the transfer and processing of your information in the United States.
